The controller of personal data collected through operandi-systems.com and the Operandi software is:

Szymon Kaczmarczykoperating under the brand Operandi SystemsEmail: [email protected]

2. Data protection contact

The controller is not required to appoint a Data Protection Officer (Article 37 GDPR) and has not appointed one. For any matter concerning personal data, write to [email protected]. General enquiries, trials and subscriptions go to [email protected].

3. What data we process

We process only the contact and billing data of representatives and employees of business customers:

  • first and last name,
  • business email address and phone number,
  • job title or role in the organisation,
  • company details for invoicing (company name, tax ID, registered address),
  • the content of the correspondence you send us.

PLC code, project files, memory dumps and machine logs are not personal data within the meaning of Article 4(1) GDPR, unless they contain information identifying natural persons. We treat them as the customer's trade secret. Please do not include personal data in the code you send us.

4. Purposes and legal bases

  • answering your enquiry and sending the trial version (Article 6(1)(f) GDPR, our legitimate interest in communicating with business customers),
  • concluding and performing the licence agreement (Article 6(1)(b) GDPR),
  • issuing and storing invoices and accounting records (Article 6(1)(c) GDPR),
  • defending against claims and handling technical support requests (Article 6(1)(f) GDPR).

5. Website, cookies and logs

This website does not use cookies, analytics tools or advertising pixels. Fonts and media files are served from our own server. The hosting provider (Cloudflare, Inc.) may keep technical server logs (IP address, date, requested URL) for a short time to keep the website secure and running.

6. Recipients

Data may be shared only with companies that help us run the business: the hosting provider and the email provider (Cloudflare, Inc.), under data processing agreements.

Payments are handled by Polar Software, Inc., which acts as the seller (Merchant of Record) and as an independent controller of purchase and payment data under its own privacy policy.

Where a provider processes data outside the European Economic Area, this is based on a European Commission adequacy decision or standard contractual clauses.

7. Retention and security

  • We keep correspondence for as long as needed to handle the enquiry and then until any claims become time-barred.
  • We keep billing data for the period required by tax law (5 years from the end of the tax year).
  • In the cloud version of the tool, code files are deleted from server memory as soon as the translation finishes (maximum buffering time 15 minutes).

8. Your rights

You have the right to access, rectify and erase your data, to restrict processing, to data portability and to object to processing. Send requests to [email protected]. You may lodge a complaint with the Polish supervisory authority, the President of the Personal Data Protection Office (UODO, ul. Stawki 2, 00-193 Warsaw), or with the supervisory authority in the EU country where you live or work.

Providing data is voluntary, but without it we cannot answer your enquiry or conclude an agreement. We do not make automated decisions and do not profile.
